Terms of Service.

Effective October 29, 2026. These Terms of Service govern your access to fromafar.app and the Afar software, applications and optional network services provided by Imagine That AI LLC (“Afar”, “we”, “us” or “our”).

1. Agreement to these Terms

By downloading, installing, pairing or using an Afar application or visiting fromafar.app (collectively, the “Services”), you agree to be bound by these Terms of Service and our Privacy Policy. If you obtain an Afar application through the Apple App Store, the supplemental End User License Agreement also applies to your use on Apple-branded devices. If you do not agree to these Terms, do not install or use the Services.

Arbitration notice: Section 11 contains a binding individual arbitration agreement and a waiver of class actions and jury trials. You may opt out of arbitration within 30 days of first accepting these Terms by following the instructions in Section 11.

2. Eligibility and single-operator accounts

You must be at least 18 years old (or the age of legal majority where you live) and legally able to form a binding contract to use the Services. Personal Afar plans (Free, Afar BYO-Network, Afar Solo and Afar Pro Fleet) are licensed to one human operator across that person’s enrolled devices. You sign in to Afar only with Apple or Google. You are responsible for safeguarding access to that Apple or Google account and to your enrolled devices, and for activity conducted from them. If you use Settings Sync, its Recovery Key recovers your synced settings only; it can’t recover your Afar account or your Apple or Google account.

3. Authorized-device and employer-consent warranty

Afar is a tool for viewing and controlling computers that belong to you or that you are explicitly authorized to administer. Each time you install the Afar host service, scan a pairing code, approve a six-digit pairing code, open a screen or terminal session, transfer or edit workspace files, or trigger a saved action, you represent, warrant and covenant that:

  • Lawful ownership or written permission. You are the lawful owner of the target computer, or you hold current, explicit, verifiable permission from the computer’s lawful owner (and, where the computer or network is provided or managed by an employer, client, school or institution, from an authorized representative of that organization) to install remote-access software and access that computer remotely.
  • Notice to other users at the desk. Where anyone else uses or sits in front of a paired computer, you are solely responsible for providing all notices and obtaining all consents required by workplace, privacy, wiretap and computer-access laws before viewing a screen, reading terminal output or taking interactive control.
  • No unauthorized access. Using Afar to access, monitor, control or extract data from any device, account or network without authorization strictly violates these Terms and may violate civil and criminal statutes, including the United States Computer Fraud and Abuse Act (18 U.S.C. § 1030) and equivalent laws in other jurisdictions.

4. How Afar operates: transport-only relay and zero-knowledge sync

  • Your own computers, not hosted virtual machines. Afar connects your viewer devices to your own Mac desktop, terminal and workspace files. Personal and team Afar plans do not rent hosted virtual machines and do not bundle third-party AI models or AI subscriptions.
  • Transport-only relay boundary. On home Wi-Fi and over your own Tailscale or VPN (Afar BYO-Network), session traffic flows directly between your devices without passing through our relay servers. When you use the managed relay in Afar Solo or Afar Pro Fleet, Imagine That AI LLC operates strictly as an encrypted network conduit: we route encrypted session packets between your authorized devices and do not inspect, record or store your terminal sessions, screen frames or workspace files.
  • Zero-knowledge Settings Sync. Optional Settings Sync (512 KiB across up to 32 devices, currently in preview) encrypts appearance, layout and workspace preferences on your device before upload using AES-256-GCM, per-device HPKE key wrapping and a 56-character Recovery Key. Because Imagine That AI LLC never holds your plaintext sync key or Recovery Key, we cannot read your synced settings and cannot recover encrypted sync records if you lose both all enrolled devices and your Recovery Key.
  • Opt-in prompt alerts (Afar Pro Fleet). Afar Pro Fleet includes support for one (1) verified iMessage or SMS contact to notify you when a build or terminal prompt waits unanswered for more than two minutes. Enrolling a phone number or Apple ID handle requires verification of that destination, standard carrier messaging and data rates may apply, and you can disable alerts or remove the contact at any time.

5. Plans, trials, relay limits and cancellation

Current plan tiers and limits are published on the Pricing page (Free at $0 on home Wi-Fi; Afar BYO-Network at $49 a year; Afar Solo at $15 a month or $119 a year; Afar Pro Fleet at $29 a month or $249 a year). Prices are in US dollars and don't include sales tax. Where tax applies, it's worked out from your billing address at checkout and added to the price shown; your receipt lists price, tax and total separately. Paid plans aren't on sale yet, so nothing on this site charges you today. Plans are bought on your account page, which shows each plan’s automatic-renewal terms for you to agree to before payment, and are billed by Stripe.

  • 14-day free trial, once per customer, and automatic renewal. New paid subscriptions start with a 14-day free trial. The trial is available once per customer: if you have had an Afar trial or paid plan before, a new subscription starts billing immediately. During the trial, managed relay on Afar Solo and Afar Pro Fleet is limited to 1 GB in total; Afar BYO-Network includes no managed relay. Unless you cancel before the trial ends, your payment method is charged the monthly or annual subscription fee plus applicable tax, and the subscription renews automatically each month or year until you cancel.
  • Relay limits with no overage fees. Managed relay allowances (20 GB a month on Afar Solo, 60 GB a month on Afar Pro Fleet) pause relay traffic when 100% of the allowance is used. We never charge automatic overage fees; local Wi-Fi and BYO-Network connections remain available even when your monthly relay allowance is used up.
  • One-click cancellation where you subscribed. If you subscribed on the web (including from the Afar apps), cancel in one click at your account page or in the Afar apps. Cancelling stops future renewals; you keep paid access until the end of the current billing period and can undo the cancellation until then. If you subscribed through Apple In-App Purchase, manage or cancel it in your Apple ID subscription settings. Apple Family Sharing is not enabled for Afar subscriptions.
  • Fallback to free local access. Cancelling a paid subscription stops future renewals at the end of the current billing period and leaves local home Wi-Fi access working at no charge. We never hold your own computer hostage behind a subscription.
  • Failed renewal payment (web billing). If a renewal payment fails, paid access away from your desk pauses immediately. Stripe retries the card, and paid access returns automatically when a payment succeeds; you can update your card at your account page. Free access on your home Wi-Fi keeps working throughout. If no retry succeeds and the subscription is cancelled for non-payment, the account returns to Free.
  • Full refunds and payment disputes. If a payment is refunded in full or disputed with your card issuer, the subscription it paid for is cancelled immediately and the account returns to Free. A partial refund doesn’t change your plan.
  • Refunds. For direct web purchases, you may request a refund within 14 days of your initial charge by writing to hello@fromafar.app. Refund requests for Apple App Store or Google Play purchases are handled by Apple or Google under their respective store policies.

6. Acceptable use and safety containment

You agree not to: (a) probe, scan, attack or bypass authentication, rate limits or cryptographic checks on Afar endpoints; (b) use the managed relay to distribute malware, run denial-of-service traffic, proxy commercial content delivery networks or violate third-party rights; (c) misrepresent device identity, spoof pairing prompts or circumvent operating-system permission dialogs; or (d) resell or sublicense managed relay bandwidth.

To protect users against active vulnerabilities or compromised credentials, Afar’s managed relay refuses host and viewer app versions older than the minimum it supports, as each app reports its version, and Afar supports immediate device and session removal, as described on our Security page.

7. High-risk systems disclaimer

THE SERVICES ARE NOT FAULT-TOLERANT AND ARE NOT DESIGNED, MANUFACTURED OR INTENDED FOR USE IN HAZARDOUS OR CRITICAL ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, INCLUDING NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, DIRECT LIFE-SUPPORT MACHINES, CLINICAL MEDICAL DEVICES, INDUSTRIAL SAFETY CONTROLLERS OR WEAPONS SYSTEMS, WHERE SOFTWARE OR NETWORK INTERRUPTION COULD LEAD TO DEATH, PERSONAL INJURY OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE. YOU AGREE NOT TO USE AFAR FOR ANY HIGH-RISK ACTIVITY.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT AND NON-INFRINGEMENT. IMAGINE THAT AI LLC DOES NOT WARRANT THAT REMOTE CONNECTIONS WILL BE UNINTERRUPTED, ERROR-FREE OR REACHABLE ACROSS EVERY FIREWALL, CELLULAR CARRIER OR POWER STATE, OR THAT COMMANDS YOU RUN ON YOUR COMPUTERS WILL PRODUCE ANY PARTICULAR RESULT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL IMAGINE THAT AI LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AFFILIATES OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, WORKSPACE FILES, CREDENTIALS, BUILD OUTPUTS OR DATA, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF IMAGINE THAT AI LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO IMAGINE THAT AI LLC FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED UNITED STATES DOLLARS (US$100.00). SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIABILITY LIMITATIONS; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify and hold harmless Imagine That AI LLC and its officers, members, employees and agents from and against any third-party claims, liabilities, damages, losses and reasonable legal fees arising out of or relating to: (a) your breach of these Terms, including the authorized-device and employer-consent warranties in Section 3; (b) commands, scripts, saved actions or file modifications executed through your paired devices; or (c) your violation of any applicable law or third-party right.

11. Dispute resolution, binding individual arbitration and class-action waiver

  • Informal resolution first. Before filing a formal claim, you agree to send a written notice describing the dispute and requested relief to hello@fromafar.app so both sides have 30 days to resolve it informally.
  • Binding individual arbitration. Except for individual claims eligible for small-claims court and actions seeking injunctive relief to stop unauthorized access to computers or intellectual-property infringement, any dispute, claim or controversy arising out of or relating to these Terms or the Services will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (adr.org) under its Consumer Arbitration Rules, governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
  • Class-action and jury-trial waiver. YOU AND IMAGINE THAT AI LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. IF THIS CLASS-ACTION WAIVER IS HELD UNENFORCEABLE AS TO A PARTICULAR CLAIM, THAT CLAIM MUST PROCEED IN COURT RATHER THAN ARBITRATION.
  • Coordinated mass-filing batching. If 25 or more substantially similar arbitration demands are filed by or with the assistance of the same counsel or coordinated group within 90 days, the AAA will administer them in staged bellwether batches of up to 20 demands at a time, followed by a 60-day mediation window before subsequent batches proceed, with filing fees due only as each batch is convened.
  • 30-day right to opt out. You may reject this arbitration agreement by sending an email to hello@fromafar.app within 30 days of first accepting these Terms stating your name, the account or device identifier (if any) and your clear election to opt out of arbitration. Opting out does not affect any other part of these Terms.

12. Governing law, changes and contact

Except to the extent preempted by federal law, these Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in California. If any provision of these Terms is held invalid, the remaining provisions remain in full force.

We may update these Terms as Afar evolves and will post the updated effective date at the top of this page. For material changes affecting active paid subscribers, we will provide advance notice before the next renewal cycle. General questions reach hello@fromafar.app, and security vulnerability reports reach security@fromafar.app.

13. Closing and deleting your account

You may delete your account at any time in the Afar apps or at your account page; Deleting your account explains the steps. Deletion takes effect immediately and can’t be undone. It cancels any subscription immediately (not at the end of the billing period) and doesn’t by itself refund the time left; revokes Sign in with Apple for Afar, if you used it; signs you out everywhere; and deletes your account, sign-in identities, sessions and stolen-device records as described in the Privacy Policy. Stripe keeps its own payment records, which we can’t delete, and we keep the records the Privacy Policy describes as kept after deletion. Deleting your account doesn’t delete files or pairings on your own computers; remove those as the deletion page explains. If your Apple ID is deleted and it was your only way to sign in, we delete your Afar account when Apple tells us. Cancelling a subscription without deleting your account instead keeps paid access to the end of the period under Section 5.
